He says the "vitriolic" reaction to the news of the video by some in the media and at universities has made it difficult for victims of this kind of crime to speak up.
"We need a national conversation about how we respond to hate crime," he says. "But this case is very powerful and a great example of how the internet makes it easier for hate crimes to take place.
"It's not about what's going on on the internet, it's about what people on the ground are experiencing."
He says victims in this case are still receiving support from many of the same organisations who were involved in his successful prosecution of Ian Roberts.
He says if they can't speak out because of a fear of being called a racist, the best option is for them to file complaints with police through the Rotherham Association.
He has also contacted the police commissioner to find out how it is that the police in England and Wales failed to act after a number of similar cases emerged last week.
He has sent a letter to the chief constable of police urging him to "step up policing" of social media sites such as Twitter and Facebook.
Mr Justice Thomas said he had no personal knowledge of the case.
His ruling will mean it is legally the right of every registered sex offender to view videos containing child abuse.
There are currently a number of laws banning the dissemination of material such as the video of the rape and the hate crime, which Mr Justice Thomas said could lead to a prosecution.

I am aware of an employee who lost all of her savings on a company fund and she has taken the matter up with the HR department as well as the company. While I was told that they are very strict in this regard, for what it's worth, they told her that they had found her a new employer, and the employee would be working from home. They added that after talking with the HR department I also learned that there were no hard and fast rules when it comes to how they handled this situation.
What they didn't say is that all the company employees are legally authorized to start a company from scratch, or from scratch with just a few hours in their spare time. However, you never know. If you lose all your cash before you start, or if you just don't have enough cash to start in a business, then maybe the company might be better served with some help.
